TERMS AND CONDITIONS OF USE

 

These terms and conditions of use (hereinafter referred to as "T&C") define the conditions under which any adult natural person may access the Site. They present the rights and obligations of Users and constitute the contract that binds them to the Publisher. By continuing to browse the Site, Users accept without reservation the following provisions and conditions of use. The Publisher is free to modify these T&C at any time, in particular to take into account any legal, regulatory, jurisprudential, and/or technical developments. The current version of the T&C is the one available online on the Site and is the only enforceable version throughout the use of the Site until it is replaced by a new version.

 

ARTICLE 1 – LEGAL INFORMATION AND DEFINITIONS

1.2 Definitions

 

The terms beginning with a capital letter in these T&C, whether used in the singular or plural, shall have the meaning given below:

 

•    “Content” means, without this list being exhaustive, the structure of the Site, editorial content, drawings, illustrations, images, photographs, graphic charters, trademarks, logos, acronyms, corporate names, audiovisual works, multimedia works, visual content, audio and sound content, as well as any other content present on the Site and/or any other element composing the Site.
•    “User” or “You” means a natural person of legal age who accesses the Site for their own needs, strictly for personal and non-commercial use, without direct or indirect profit.
•    “Site” means the official website of MyLicence.mu, whose address is: https://www.molearner.mu

 

ARTICLE 2 – PURPOSE OF THE SITE

 

The Site aims to provide You with access to information about the products and services offered by the Publisher, to allow You to purchase these products and services online, and to enable You to access your personal space “My Account.”

 

ARTICLE 3 – ACCESS TO THE SITE

 

Access to the Site is free and open to all. However, certain functionalities, such as purchasing services or products, are reserved for adults with the legal capacity to contract. The Publisher reserves the right to request proof of the User's age to validate an order. A warning message will be displayed when accessing services requiring legal adulthood, informing Users that only adults can complete a purchase on the Site. The Site is freely accessible to any User with an internet connection. All costs, charges, and expenses incurred by the User to access the Site (computer equipment, software, internet connection, etc.) are their sole responsibility.

 

ARTICLE 4 – INTELLECTUAL PROPERTY OF THE SITE

 

The Site and its Content, and more generally all elements reproduced or used on the Site, are protected by intellectual property laws and any other applicable laws or regulations in Mauritius. They are the exclusive property of the Publisher or its partners. Any reproduction, representation, use, or adaptation, in any form whatsoever, of all or part of these elements, including computer applications, without the prior written consent of the Publisher, is strictly prohibited. The Publisher’s failure to initiate legal proceedings upon becoming aware of unauthorized use does not constitute acceptance or a waiver of the right to prosecute. Regarding online order services, all information available on the Site is exclusively valid for Mauritius and Rodrigues.

 

ARTICLE 5 – USER OBLIGATIONS

 

The User expressly agrees:

 

•    To access the Site on their equipment exclusively for personal and non-commercial use;
•    Not to permanently or temporarily reproduce the Site, in whole or in part, by any means and in any form;
•    Not to use software or processes intended to copy the Content without the prior written authorization of the Publisher;
•    Not to engage in any adaptation, modification, translation, transcription, arrangement, compilation, decompilation, assembly, disassembly, transcoding, or apply reverse engineering to all or part of the Site and/or Content;
•    To expressly refrain from using software or devices likely to disrupt the proper functioning of the Site;
•    Not to extract or reuse, including for private purposes, without prior written authorization from the Publisher, a substantial or non-substantial part of the content of the databases and archives constituted by the Site;
•    Not to implement systems likely to hack the Site and/or the Content in whole or in part or to violate these T&C;
•    To inform the Publisher as soon as they become aware of any act of hacking, particularly any illegal or non-contractual use of the Site and/or the Content, regardless of the mode of distribution;
•    Not to sell, rent, sublicense, or distribute the Site and/or the Content to third parties in any way.

 

ARTICLE 6 – BROWSING AND REGISTRATION ON THE SITE

 

6.1 Browsing

 

The User browses the Site freely and free of charge, with or without registration.

 

6.2 Registration

 

Registration on the Site is free and optional. User registration becomes mandatory to use online training services. To register, the User must complete a form providing the Publisher with information allowing their identification, including their full name, postal address, email address, and phone number. Upon registration, the User must create a username and password of their choice, which will be personal and confidential. Subsequent identification on the Site will require the User to provide their username and password. Entering the User’s credentials constitutes proof of their identity on the Site, and the Publisher cannot be held responsible for any damage or harm resulting from the misuse or theft of the User's credentials. The User agrees to provide accurate information upon registration and to update it in case of changes.The User is solely responsible for the use of their credentials, even if they pre-register their identifier on their computer, mobile phone, or any other device, enabling automatic login to the Site. Any access, use of the Site, and transmission of data from a User's account shall be irrefutably presumed to have been carried out by the User. The security of the User’s credentials is their full responsibility. Therefore, the User must ensure they log out of the Site at the end of each session, especially when accessing the Site from a public computer. Any loss, misappropriation, or unauthorized use of a User’s credentials and their consequences are the User’s sole responsibility. In such cases, the User must notify the Publisher immediately by email at [email protected], specifying their credentials, full name, and other identifying details so the Publisher can reset the User’s account.

 

ARTICLE 7 – SITE AVAILABILITY AND MANAGEMENT

 

The Publisher commits to making its best efforts to secure access, consultation, and use of the Site. The Site is accessible 24/7, except in cases of force majeure or an event beyond the Publisher’s control, or in case of necessary maintenance operations for the proper functioning of the Site. To ensure the proper management of the Site, the Publisher may at any time:

 

•    Suspend, interrupt, or limit access to all or part of the Site;
•    Restrict access to the Site, or certain parts of it, to a specific category of Users;
•    Delete any information that may disrupt its operation or conflict with national or international laws;
•    Suspend the Site to carry out updates.

 


ARTICLE 8 – LIMITATION OF LIABILITY

 

Access to and use of the Site are at the User’s own risk.It is the responsibility of every User to take all appropriate measures to protect their own data and/or software stored on their electronic, computer, and telephone devices against any breaches. The User acknowledges and accepts the characteristics and limitations of the Internet, particularly its functional characteristics and technical performance; issues related to Internet connection and/or access to websites; issues concerning network availability and congestion; failures or network saturation; the lack of protection for certain data against potential misappropriation or hacking; risks of contamination by potential viruses circulating on said networks, etc., for which the Publisher cannot be held responsible in any case.

 

The Publisher cannot be held liable:

 

•    In case of failure, delay, or error in data transmission beyond its control; 

•    For the sending of messages and/or data to an incorrect, erroneous, or incomplete address; 

•    If, for any reason, the data does not reach the Publisher or arrives illegible or impossible to process; 

•    If the User is unable to access or use the Site, the Application, and/or the Services for any reason; 

•    If, for any reason, the connection is interrupted.

 

The User understands and agrees that the Publisher cannot be held liable for any damage or loss, of any nature, caused to Users, their devices, their computer and telephone equipment, and the data stored therein, nor for any consequences that may arise from their personal, professional, or commercial activities. The User expressly waives any action against the Publisher on this basis.

 

ARTICLE 9 – HYPERLINKS

 

If the Site contains hyperlinks to third-party websites, the Publisher assumes no responsibility for the content of such third-party websites or the content to which those third-party sites may direct. The presence of hyperlinks to third-party websites does not imply any endorsement of their content by the Publisher. The Publisher is not responsible for any modifications or updates related to third-party websites. The Publisher is also not responsible for the transmission of information from third-party websites, nor for their malfunction. The placement of any hyperlinks by the User to any part of the Site is strictly prohibited without the Publisher’s prior written authorization, requested via email at the following address: 6th - 7th Floors, Shehnaz Tower 30, Louis Pasteur Street, Port Louis. The Publisher reserves the right to refuse this authorization without having to justify its decision. If the Publisher grants authorization, it is only temporary and may be revoked at any time without justification. In any case, all hyperlinks must be removed upon the Publisher’s simple request. Any information accessible via a link to other third-party websites is beyond the control of the Publisher, which disclaims all responsibility for its content.

 

ARTICLE 10 – PERSONAL DATA PROTECTION

 

By accepting these T&C, the User expressly agrees to the Privacy Policy, which forms an integral part of these T&C.

 

ARTICLE 11 – PHOTOGRAPHS AND PRODUCT REPRESENTATION

 

All visuals such as images, videos, or animations representing a product/service and accompanying their description are non-contractual and presented for purely illustrative purposes. They do not, under any circumstances, engage the Publisher’s responsibility.

 

ARTICLE 12 – APPLICATION AND CHANGES TO THE T&C

 

The T&C apply to every User of the Site. The User is invited to read the T&C carefully with each visit, as they are accessible via a hyperlink on the homepage of the Site and may be modified at any time without prior notice by the Publisher. The applicable T&C are those in force on the date of the User's connection to and use of the Site. The Publisher reserves the right to modify all or part of the provisions of the T&C at any time without prior notice or information to Users, to adapt them to changes in Services, technological developments, legal or case law changes, or the implementation of new services. Any modifications made by the Publisher to the T&C will be made available to Users by simply publishing them online. They will be irrebuttably presumed to be accepted without reservation by any User who accesses the Site after their publication. The Publisher therefore invites all Users to regularly review the T&C. Any new Service incorporating new techniques or new features improving the quality of existing Services will also be subject to these T&C unless expressly stated otherwise.

 

ARTICLE 13 – APPLICABLE LAW AND JURISDICTION

 

These T&C are governed by Mauritian law and are subject to the exclusive jurisdiction of the courts of Mauritius, except where a specific jurisdiction is provided by law or regulation.
